You have been violated! What should you do...this week at the Inventors Council

We have often had attorneys attend the Tampa Bay inventors Council and talk about changes in patent law, steps to acquire a patent, different types of patents, and other forms of intellectual property. This Wednesday we’re going to look at the other side of intellectual property and that is protecting it when it has been violated. If you find that somebody is making a product that violates your patent, how do you go about stopping them or bringing them into compliance. What is your responsibility for due diligence when someone violates your intellectual property. Should you go about litigating? What will it cost and what will it cost you if you don't litigate? Sometimes a violator can be turned into a licensee if you don't poison the water on your approach. Handling a complex matter such as this is best handled by someone with experience. This Wednesday we are joined by Suzette Marteny, a practicing IP attorney in Tampa Bay. Some of you may know her as the attorney for My Cool inventions and others may know her from working with Ken Evans. She represents both plaintiffs and defendants in complex business litigations with claims such as patent, trademark and copyright infringement; trade secret misappropriation; Internet domain name disputes; state and federal unfair competition and the like. Her experience also includes representing clients in Cancellation and Opposition proceedings in the United States Patent & Trademark Office.  She advises clients on US and international transactional matters related to intellectual property, information technology, computer, Internet, new media (podcasting, blogging), software development, online gambling and sweepstakes laws. She has experience developing internal business procedures for the protection of IP rights, preparing contracts such as manufacturing and supply agreements, intellectual property licenses, software and content development agreements and distribution agreements.  She is agreed to share her wisdom and experience with us this Wednesday so that we will know better how to deal with a situation like this should one pop up.
